When you’re charged with driving while intoxicated in Hawai’i, the Administrative Driver’s License Revocation Office (ADLRO) may revoke your driver’s license. This means you are not allowed to legally drive until the revocation is up. However, we can tell you how to get your license back after a DUI in Hawai’i.

It is possible to appeal the ADLRO’s initial decision and restore your license with the help of an experienced lawyer. This lets you return to the road before you even hear your DUI case’s final verdict. If the ADLRO rescinds its decision, the revocation is reversed, and your license is restored without the need to earn your driving privileges back.

The ADLRO and OVUIIs

The ADLRO of Hawai’i legally refers to DUIs as OVUIIs, or operating a vehicle under the influence of an intoxicant. When you are arrested for an OVUII, the ADLRO reviews your case to decide whether or not to revoke your license. This is separate from a criminal DUI charge, but both can keep you off the road for years.

When your license is revoked, you must wait until the revocation period is over before completing the required driver’s education courses. Upon completion, you can request a re-licensing form from the ADLRO and re-license at your local DMV. However, you can appeal this decision and earn your license back before the revocation period is over.

Appealing an ADLRO Decision in Hawai’i

The ADLRO is a busy organization. In 2022 alone, the U.S Department of Transportation found that out of all the drivers involved in fatal accidents that year, 21% were alcohol-impaired. As such, the ADLRO is not afraid to suspend licenses even when your DUI case has yet to receive a single hearing.

Because of this, the ADLRO offers a special appeal process that can restore your license before the end of the initial suspension. To appeal, you must first request a reconsideration within three days of your DUI arrest. The ADLRO will then take up to eight days to study your case before either rescinding or sustaining their decision. If they sustain the decision, you can request a hearing within six days.

The location of your ADLRO hearing depends on where in Hawai’i you are. The ADLRO generally prefers to host their hearings at the circuit courts of each island. If you were arrested in Oahu, your ADLRO hearing may take place at the First District Court, located at 1111 Alakea Street in Honolulu. A skilled DUI attorney can help represent you at this hearing and advocate for a rescinded revocation.
